How Long Do I Have to File a Car Accident Claim in Florida?
In Florida, the statute of limitations for filing a personal injury lawsuit stemming from a car accident is generally two years from the date of the crash. This two-year deadline applies to accidents that occurred on or after March 24, 2023, as Florida law was updated in 2023, reducing the previous four-year limit for most negligence-based claims. If the accident happened before this date, the older four-year deadline may still apply. Note that claims solely for property damage still typically fall under a four-year statute of limitations.
For wrongful death claims resulting from a car accident, the deadline is also two years, but it begins from the date of the victim’s death, which is not necessarily the accident date. It is important to understand that if you fail to file your lawsuit before the applicable deadline, a court will almost certainly dismiss your case, effectively preventing you from recovering compensation even if the other driver was clearly at fault.
